Your privacy is important to STACYC, LLC, its affiliates, subsidiaries and parent companies, including but not limited to LiveWire EV, LLC and LiveWire Netherlands BV (“STACYC,” “we,” “our,” or “us”). As parents, bike dealers and overall bike enthusiasts, we know you like to be informed and we are committed to protecting your privacy through our compliance with this Privacy Notice (this “Notice”). STACYC, LLC is the controller of your personal information.

WHEN OUR PRIVACY NOTICE APPLIES 

 

This Notice applies to information we collect about you when you use the STACYC websites that link to this Notice, when you purchase our products, or otherwise interact with us (for example, by contacting us over the phone) (collectively, the “Services”). This Notice will let you know what kind of personal information we collect through our Services, how we collect that information, and what we do with it. This Notice also explains certain rights you may have dependent on the jurisdiction in which you live.  

 

CHILDREN UNDER THE AGE OF 16  

Our websites are not intended for anyone under the age of 16, and we do not knowingly collect or sell personal information from children under 16. In the event that we learn that we have collected personal information from a child under the age of 16, we will delete that information. CATEGORIES OF PERSONAL INFORMATION WE COLLECT 

Personal information is any information relating to an identified or identifiable natural person. Your name, address, phone number and bank account number are all examples of personal information. In the past twelve (12) months, we have collected the following categories of personal information: 

  • Identifiers, such as your name, email address, telephone number, mailing address, or business name;  
  • Account Information, such as login information; 
  • Communications, such as messages you submit via the Services; 
  • Commercial Information, such as payment information, order information, order history, warranty information, and service history; 
  • Demographic Information, such as age and gender; 
  • Inference drawn about you, such as your preferences, characteristics, or attitudes; and 
  • Internet or other network information, such as IP address, browser type and version, type of device you use, operating system version, and device identifier, geographic location, pages you view, how you got to our website and any links you click on to leave our website, metadata and user behavioral metrics about your use of our website and emails we send to you (including clicks and opens), and metadata about how you interact with our website. 

DEALER INQUIRIES 

We use POWr, Inc. (“POWr”) to manage all form submissions. By submitting a form, you acknowledge that the information you provide will be transferred to POWr for processing in accordance with their Terms of Use at https://www.powr.io/terms and Privacy Notice at https://www.powr.io/privacy. 

SOURCES OF INFORMATION 

We collect personal information directly from you, for example when you provide it to us, when you contact us through our Services, when you create an account with us, and indirectly from you automatically through your computer or device as you use our Services. We may also collect personal information about you from our advertising partners and service providers.  

Information from Third Parties. 

We receive information about individuals from our third-party service providers, affiliates, agents, social media services, and advertising partners. For example, we contract with third parties to assist us with analytics, emails, and other business purposes. We use the information collected by third parties to improve our content, products, and services, to inform groups of users about relevant products and services, and to help us analyze the Services and the effectiveness of our marketing.  

In addition, we collect information on our email campaigns from our third-party service providers, including whether you have read an email sent by us or on our behalf, forwarded an email, and when and how many times you have opened an email. We may use this information to improve our marketing, to understand our audience, and to improve the Services and our products.

Automatic Information Collection Technologies. 

When you use or interact with our Services, we may use a variety of technologies that collect information automatically, including cookies, web beacons, flash cookies, and logging. Those technologies may collect, among other things, your IP address, location, device type, date and time of visit, operating system, and browser type, as well your activities on the Services. HOW WE USE INFORMATION 

 We may  use information we collect automatically from you that is de-identified, aggregated, or anonymous, for any purpose.  We may use your personal information: 

  • To respond to any request you have made, including for information and/or products; 
  • For our marketing efforts, including to keep you informed about existing and new products; 
  • To provide you with customer support and communicate with you; 
  • To resolve problems and disputes with the Services; 
  • To improve the Services and our products; 
  • To protect the security and integrity of the Services; 
  • To monitor compliance with and enforce this Notice and any other applicable agreements and policies; 
  • To prevent fraud and otherwise protect our business; 
  • To offer various sweepstakes, contests, or giveaways; 
  • If necessary, to notify you about changes to the Services and any products we offer; 
  • In any other way we may describe when you provide the information; and 
  • To fulfill any other purposes for which you provide it or offer your consent. 

FINANCIAL INCENTIVES 

 

We may offer you certain financial incentives (discounts, giveaways, etc.) permitted under applicable privacy laws.  Any permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program's material aspects.  In some places, participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time. 

 

LEGAL BASIS FOR PROCESSING  

 

If you are an individual in the European Economic Area (EEA), we collect and process information about you only where we have legal bases for doing so under applicable laws.  The legal bases depend on the Services you use and how you use them. This means we collect and use your information only where: 

  • We need it to fulfill our contractual obligations or provide you the Services, including to operate the Services, provide customer support and personalized features and to protect the safety and security of the Services. If you do not provide personal information that is required to fulfill a contract, we may not be able to provide our product or Services to you; 
  • It satisfies a legitimate interest (which is not overridden by your data protection interests), such as for research and development, to provide our website and tailor your experience to you, to keep the Services safe and secure, to market and promote our products, to improve our products and Services, to communicate with you about our products, to enforce our contracts, and to protect our legal rights and interests;

If you have consented to our use of information about you for a specific purpose, you have the right to change your mind at any time, but this will not affect any processing that has already taken place.  Where we are using your information because we, or a third party, have a legitimate interest to do so, you have the right to object to that use though, in some cases, this may mean no longer using the Services.

SELLING, SHARING, AND TARGETED ADVERTISING  

When you interact with our Services, we may use, or authorize third-party partners and service providers to use, cookies, web beacons and similar technologies to improve your experience with us. For more information regarding how we use these technologies, please see the section titled “Automatic Information Collection Technologies.” Our sharing of your personal information in this way may constitute “selling”, “sharing”, or using for “targeted advertising” under applicable U.S. state privacy laws. The term "sale" may include sharing personal information for monetary or other valuable consideration under applicable U.S. state privacy law.

In addition, some browsers offer you the ability to opt-out of the sharing of your personal information by turning on a Global Privacy Control. You can turn on a Global Privacy Control in your web browser or browser extension or by visiting https://globalprivacycontrol.org/. Please see the California Privacy Protection Agency’s website at https://oag.ca.gov/privacy/ccpa for more information on valid Global Privacy Controls. At this time, we endeavor to respond to browser-based opt-out signals sent through the Global Privacy Control. 

YOUR CHOICES ABOUT OUR COLLECTION, USE, AND DISCLOSURE 

We strive to provide you with information and choices regarding the information you provide to us and that we collect, including: 

Email Opt-Out.  

You may opt-out of receiving future communications from us any time we request your personal information. You can opt-out by using the unsubscribe process at the bottom of the email or by emailing us at privacy@stacyc.com with “unsubscribe” in the subject line. We will use commercially reasonable efforts to process such request in a timely manner. 

Your Rights. 

You may have certain rights relating to your personal information subject to local data protection laws. Depending on where you live and subject to certain exceptions, you may have the following rights: 

 

  • Right to Know: The right to request any or all of the following information relating to your personal information we have collected and disclosed, upon our verification of your identity: 
  • The categories of personal information we have collected about you. 
  • Our business purpose for collecting that personal information. 
  • The categories of third parties with whom we disclose that personal information. 
  • The specific pieces of personal information we have collected about you. 
  • The categories of sources of the personal information we have about you. 
  • Right to Request Deletion: The right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. 
  • Right of Portability: The right to request a copy of your information in an accessible format.  
  • The Right to Correct: The right to correct inaccurate personal information that we maintain about you. 
  • The Right to Withdraw Consent or Limit Processing: Where processing of personal information is based on consent, you have the right to withdraw your consent at any time. Where processing of personal information is based on legitimate consent, you also have the right to request we limit or restrict how we use your information. 
  • The Right to Opt-Out of the Targeted Advertising, the Sale or Sharing of Your Personal Information, and Profiling in Certain Circumstances:  The right to direct us not to sell or share personal information we have collected about you to third parties for targeted advertising.  
  • The Right to Non-Discrimination: The right not to receive discriminatory treatment for exercising these rights. 
  • “Shine the Light”: California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information to a third party for the third party's direct marketing purposes. 
  • The Right to Appeal: The right to appeal our decision regarding your request within a reasonable time period dependent on applicable law.  
  • The Right to Make a Complaint: The right to make a complaint to your local government or supervisory authority if you feel your rights have been violated. 

 

Exercise Your Rights.  

To exercise your rights described above, please submit a verifiable consumer request to STACYC by emailing us at privacy@stacyc.com 

Only you, or a person that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. If you are making a request on behalf of another person, you must provide written legal documentation that you are authorized to act on behalf of that individual. The verifiable consumer request must: 

  • Provide sufficient information that allows STACYC to reasonably verify you are the person about whom it collected personal information or an authorized representative; and 
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. 

We may not be able to fulfill your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. To verify your identity, we may request up to three pieces of personal information about you, and we reserve the right to take additional steps as necessary to verify your identity if we have reason to believe a request is fraudulent. If you do not agree with how we responded to your request, you may ask us to review our decision by contacting us through the above noted methods. 

Response Timing & Format. 

STACYC endeavors to respond to a verifiable consumer request within 30 to 45 days of its receipt depending on where you are located. If STACYC requires more time, it will inform you of the reason and extension period in writing. STACYC will deliver the written response by mail or electronically, at your option. The response STACYC provides will also explain the reasons it cannot comply with a request, if applicable. For data portability requests, STACYC will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance

Our Services may contain links to websites operated and maintained by third parties.  

We have no control over and are not responsible for the privacy policies or content on those websites, and any links to third-party websites do not imply an affiliation between STACYC and the website owner, or any endorsement, approval or verification of any content contained on those websites. Privacy policies on third-party websites may be different from our Notice. You access such links at your own risk. You should always read the privacy policy or notice of a website before disclosing any of your information. 

Links to Our Social Media Websites.  

If you use a functionality on the Services that allow you to send content to STACYC or another user, through the use of social media platforms such as Facebook®, Twitter®, Instagram® and YouTube®, then please be aware that: (a) we may display your email address and/or social media handle (e.g. username) to the other users; (b) we may use information you provide about other users to facilitate the communication; and/or (c) we may collect information about you and other user(s) as otherwise set forth in this Notice. We may also interact with you via social media platforms. Please note that any content you post to social media platforms is subject to the specific social media platform’s terms of use and privacy Notice. 

SECURITY 

We strive to use reasonable means to secure your personal information; however, please keep in mind that the transmission of information over the Internet and on mobile platforms is not always secure, which means we cannot and do not guarantee the security or confidentiality of any personal information you provide to us. Given this reality, your use of our Services, and your decision to provide personal information to us, is at your own risk. 

DATA TRANSFERS 

Personal information you provide directly to us is processed in the United States. If you live outside of the United States, data protection laws in the United States are likely different from those of your home country. When you submit your personal information to us, you acknowledge that your personal information will be processed in the United States in accordance with this Privacy Notice. If we transfer personal information from the European Economic Area, Switzerland, or the United Kingdom or as part of an onward transfer to one of our service providers or affiliates, we will transfer the personal information to parties that provide appropriate safeguards for your personal information using an approved and valid personal information transfer mechanism, such as the European Union’s Standard Contractual Clauses or the United Kingdom’s International Data Transfer Agreement. DATA RETENTON 

We keep personal information for no longer than necessary to achieve the purposes for which the personal information was collected or as required or permitted by applicable law. To determine the appropriate retention period, we consider the scope and sensitivity of the personal information; the potential risk of harm from unauthorized access to, use of, or disclosure of personal information; the purposes for which we process personal information and whether we can achieve those purposes through other means; and applicable legal requirements.
